Nevada Graffiti Law Under NRS 206.330

Tagging, making graffiti or defacing public or private property is a serious crime in Las Vegas Nevada. A conviction can result in fines, jail time, community service and a suspension of one’s Nevada drivers license.

The penalties for a Las Vegas graffiti charge vary according to the value of the damage sustained. Specifically:

  • If the damage is less than $250, the offense is a simple misdemeanor and carries up to 6 months in jail
  • If the damage is more than $250, the offense is a gross misdemeanor and carries up to one year in jail
  • If the damage is more than $5000, the offense is a Class E Nevada felony and carries up to 4 years in state prison.

Community Service Requirements

A person convicted of a Nevada graffiti charge also faces fines and mandatory community service. On a first offense, the fine is a minimum of $400 plus 100 hours of community service. For a second or third offense, the fine is between $750 and $1000, plus 200 hours of community service. If the person fails to complete the community service, the judge can impose jail time.

Parents Are Responsible for their Children

If the Las Vegas graffiti suspect is under 18, his or her parents are responsible for paying any fines or penalties imposed by the court. If the parents can’t afford to pay these fines and penalties, the court can order the parents to perform community service.

Minors May Lose Their Nevada Drivers Licenses

If a minor (person under age 18) is convicted of graffiti in Las Vegas NV, the court will order his/her Nevada drivers license to be suspended for between 6 months and 2 years. Usually, the minor will be ordered by the judge to surrender the drivers license in court.
